Those Senators seem to feel their cursory politeness to Dr. Christine Blasey Ford was sufficient. Worse, The Eleven seem not to understand fully the concept of impeachment.
Article 1 Section 2 Clause 5 of our Constitution grants the House of Representatives the sole power of impeachment. Article 1 Section 3 Clause 6 states that the Senate shall have the sole power to try all cases of impeachment. Article 2 Section 4 declares that all civil officers of the United States shall be removed from office upon impeachment for, and conviction of, a number of offenses.
All civil officers includes judges at all levels of the federal judiciary. Including Brett Kavanaugh's current gig as Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit.
Once again, forgive the seeming legal groaners that follow. A strong case can be made that three points not only disqualify Kavanaugh from becoming a Justice, but also advocate for his removal from his current post.
- During the Senate Judiciary Committee hearing on Sept. 27th Senator Orin Hatch of Utah asked Kavanaugh when he first learned of the allegations made against him by Deborah Ramirez. Kavanaugh replied that he heard about the charges when the public in general did - after seeing an article in the New Yorker magazine.
- NBC News, on Oct. 1, reported on several text messages from Kavanaugh to friends and acquaintances, in which he requested their help in countering Ramirez' accusations. Those text messages pre-date the New Yorker article by several days, and can be considered evidence that Kavanaugh lied under oath in the above response to Hatch.
- The classic phrase high crimes and misdemeanors can be and has been interpreted as including perjury.
